JWK Digital Branding maintains zero tolerance for spam and abusive email sending practices. This policy applies to all email services provided by JWK and reflects the guidelines of the hosting infrastructure on which we operate as authorized resellers.
1. About this Policy
JWK Digital Branding is an authorized reseller of hosting services and corporate email infrastructure. As such, we are jointly responsible for the proper use of the resources we provide to our clients.
This policy establishes the responsible email use rules that apply to all clients using corporate email, transactional email, or email marketing services contracted through JWK.
Failure to comply with this policy may result in immediate suspension of services, with no right to a refund, and may result in the client being held liable for damages caused to JWK, the hosting infrastructure, or third parties.
2. Definition of Spam
For the purposes of this policy, spam is considered to be (Unsolicited Bulk Email — UBE / Unsolicited Commercial Email — UCE) any electronic message sent in bulk that meets any of the following conditions:
- The recipient did not grant explicit and verifiable permission to receive it;
- The benefit of the message is perceived unilaterally by the sender — the recipient did not request and does not expect the message;
- The sender's identity is hidden, disguised, or falsified in any way — whether in the header, the "From:" field, or the sending domain.
The presence of any of these elements characterizes the message as spam, regardless of content, stated intent, or sending volume.
3. Technical Sending Limits
Email sending resources are subject to technical limits imposed by the hosting infrastructure. Violating these limits can cause automatic server blocking and affect other users of the service.

These limits apply to emails sent via the corporate email server. For marketing campaigns at scale, JWK recommends and offers integration with specialized platforms such as Brevo, with higher limits suited to anti-spam legislation.
Note: Clients who need higher volumes must contact JWK before sending, for evaluation and possible plan upgrade.
4. Mandatory Practices
Every client sending bulk email (newsletters, announcements, campaigns) through JWK services must mandatorily:
- Confirmed opt-in (double opt-in): Every contact list must consist exclusively of recipients who requested and confirmed receipt of the messages, through a verifiable mechanism (e.g., confirmation email with activation link).
- Unsubscribe link: Every message must contain a clear and functional unsubscribe option that takes effect within a maximum of 10 business days after the request.
- Sender identification: Every message must clearly identify the sender's name and email address, as well as a valid physical or contact address.
- Truthful subject line: The subject line must accurately reflect the content of the message. The use of misleading subjects, "Re:", "Fw:", or characters intended to bypass spam filters is prohibited.
- Consent record: The client must keep records proving each recipient's consent, with date, source, and collection method, for a minimum period of 2 years.
5. Prohibited Uses
Any of the practices below constitutes a serious violation of this policy and will result in immediate suspension of services, without prior notice and without refund.
It is expressly prohibited to:
- Send messages to lists obtained by purchase, rental, scraping, or any method that does not involve individual explicit consent from each recipient
- Use unconfirmed email lists (single opt-in when the recipient did not request anything, or lists collected without consent)
- Send or facilitate the sending of spam on one's own behalf or on behalf of third parties
- Operate on behalf of or for the benefit of companies or individuals listed on ROKSO (Register of Known Spam Operations) or similar blacklists
- Falsify or hide the origin address, headers, or sender identity
- Use JWK services to distribute malware, phishing, scams, or any illicit content via email
- Send messages to addresses collected without permission from websites, forums, social networks, or any other public source
- Send volumes that exceed technical limits without prior authorization from JWK
- Bypass spam filters with special characters, unusual encodings, or any obfuscation technique
- Transfer, assign, or share email lists with third parties without the consent of the data subjects
6. Liability and Consequences
6.1 Client Liability
The client is the sole and exclusive party responsible for:
- The content of messages sent through JWK services
- The quality and legality of the email lists used
- Obtaining and maintaining valid consent from each recipient
- Compliance with Brazil's LGPD (Law No. 13,709/2018), the Marco Civil da Internet (Law No. 12,965/2014), and all applicable anti-spam legislation
- Direct and indirect damages caused to third parties by improper sending carried out from their account
6.2 Consequences of Violation
In the event of a violation of this policy, JWK may, at its sole discretion:
- Immediately suspend the client's email service, without prior notice
- Terminate the contract without refund of amounts paid
- Charge the client for direct costs incurred by JWK as a result of the violation (technical hours, hosting penalties, reputational damage to the sending server)
- Report the incident to the competent authorities and to the ANPD, when applicable
- Seek compensation for losses and damages, including lost profits, under applicable law
JWK is not liable for damages caused to third parties by acts committed by clients in violation of this policy. Responsibility for such acts is exclusively the offending client's, who must answer directly to the injured parties and the authorities.
7. Monitoring and Reports
JWK reserves the right to monitor the volume and patterns of email sending carried out by clients when there are indications of misuse. Spam reports involving JWK services can be sent to:
All reports will be investigated. JWK cooperates with investigations by authorities, email providers, and anti-spam organizations (Spamhaus, CERT.br, etc.).
8. Recommended Best Practices
Beyond the minimum requirements of this policy, we recommend:
- Always using double opt-in (link confirmation) for newsletters and marketing lists
- Performing periodic list hygiene (removal of bounces, inactives, and unsubscribes)
- Segmenting sends by recipient interest and profile for better results
- Monitoring open, click, and unsubscribe metrics — spam rates above 0.1% are a warning sign
- Authenticating sending domains with SPF, DKIM, and DMARC to improve deliverability
- Using specialized platforms (Brevo, Mailchimp, etc.) for volume campaigns
9. Reference to the Hosting Policy
This policy is complementary to and aligned with the Email and Anti-Spam Policy of our hosting infrastructure. In case of conflict, the more restrictive rule prevails. Clients are also subject to the Terms of Service of the hosting provider through which JWK operates as a reseller.
10. Changes and Effective Date
This policy takes effect on its publication date and may be updated at any time. The current version will always be available at jwk.com.br/politica-email. Continued use of the services after changes constitutes acceptance of the new conditions.
