First step

Registration Feasibility

Before filing, we conduct a prior-art search to check whether a similar or identical trademark is already registered or being registered with INPI. A critical step to avoid conflicts and ensure the application's success.

Second step

Registration Application

The application is filed electronically through INPI's e-Marcas system in Brazil. It includes the trademark submission, specification of goods and services (Nice Classification), and payment of government fees. JWK handles all documentation and filing.

Third step

Formal and Substantive Examination

INPI verifies the documentation requirements and examines the trademark for distinctiveness and possible confusion with pre-existing trademarks. If there are no obstacles, the trademark is published in the Official Industrial Property Gazette for 60 days for possible oppositions.

In the event of an opposition, our legal team monitors the case and can reverse the situation with a well-founded defense of the trademark.

Fourth step

Registration Grant

With no opposition, or after oppositions are dismissed, INPI grants the trademark registration, valid for 10 years and renewable. You gain the exclusive right to use it across all Brazilian territory.
